5 Years For Killing A Bloke By Pushing Him Under A Tram

it appears not much different to those offences where 2 drunks outside a pub get into a fight. one punch one falls over smashes head on pavement and dies. i know of several offences of that kind where the sentencce was of similar length
Her defence team were succesful in convincing the court there was no intent to push him into the tram and it appears from similar cases that is the ball park figure for the sentence

 

where's the intent?
she pushed him, he fell under a tram. prove (beyond reasonable doubt) that she intended for him to fall under the tram and suffer really serious harm. The only life sentence I know of for manslaughter is where some strikers in the miners strike dropped a concrete block on a car - argued it from murder on a technicality.

 

Surely she was aware the tramlines were there and seeing as trams are not particularly fast she would have been aware of one in close proximity. Either she knew there was a strong chance this could happen or she should be off the streets for being too stupid to be aware of the strong possibility it could happen.

For me it brings up the argument that keeps raising it's head over the last few years. Given the description of her violence over the years and agreements that she has a propensity for violence and is dangerous, what would the sentence have been if that had been a man attacking and causing the death of a woman? I doubt it would have been the same and would suggest a man doing such things would not be out in possibly in just over 3 years.

They are too fat to fit in the bins _ only kidding - and all my Dukes have been red - thus far ! The S4R does look good in blue I must say

That suggests a degree of measuredness not consistent with a fight or intoxicated people in general.
Also, she pleaded guilty, that always gets a chunk off.

 

Just read the link from Pete1950, even more gobsmacked now having read the link & how convenient CCTV proved she was lying about certain parts of the quarrel.

 

Do we believe the reportage? After all it’s not been indpendently verified and media alwqys has a skewed agenda doesnt it ...
