Not Parcelforce; but got advice in relation to suing another courier, UPS. The story would be far too long for this house. Gist of advice/research was until the item is in your sweaty palms the contract is between the seller/manufacturer & courier company. Not you. Even though you’ve paid for it. THIS is only in relation to an item that was ordered & paid for but didn’t turn up. In my case, multiple times involving air freight, contracted personnel driver, U.K. customs (twice) and 2 journeys on separate occasions from a bonded warehouse to almost my home address but then inexplicably returned back to Germany. Then re delivered to a U.K. address 200 miles from my home address. This is the heavily edited short version of my 4 month nightmare.
Cheers. Yes, I am digging in for an epic struggle. They have admitting to losing a £4000 item! I have a sneaking feeling they will try and body swerve any and all responsibility in which case I will have to take them to court.
What was your contract with them? Standard shipping? Paid for extra cover? Standard shipping gets you £150 comp. Extra cover only gets you £2500 comp. They operate under a legally binding contract which you agree to when to make the shipping arrangement. Can you prove negligence? This would strengthen things and potentially increase compensation. Here’s the kicker, as the sender you are still obligated to your buyer and would have to refund them and pursue Parcel Force. Plus if the item was ‘second hand’ Parcel Force deducts for depreciation and second hand value. Have you got a claim in already? Have you escalated it to the Postal Review Panel? Next would be small claims court.
I am. I bought 48 tracked and signed through the EBAY patform. I did not purchase extra insurance as My interpretation from the info supplied was that the item was covered by PF up to 2500 quid. However, I did contact EBAY the same morning and asked them if the service was insured and they confirmed to me on the phone that this was the case 'to the full value of the item' , I made damp sure to clarify that. Hence me not purchasing extra insurance which was not an option on the EBAY portal anyway. It's all a bit of a cluster fuck really!
My two relevant Parcel Farce experiences. 1. Seller didn't actually send the whole slipper clutch and tried to use one ebay label for two boxes - ebay refunded even though it was the sellers fault. Sorting office couldn't track two boxes with the same barcode. 2. Parcel Farce gave up, local sorting office manager went out of his way to find the parcel and I picked it up from the office. Common factor - The Royal Mail sorting office staff were absolute stars.
Thanks to Zhed....sued (that might be the wrong phrase...took them to small claims court) them and won about 5 years back, even to the point i had the regional manager of Parcelforce phoning me trying to worm his way out of it... I had a couple of hilarious exchanges with him and their accounts department when it came to them paying up...
Just to the OP....Zhed gave me the knowledge on what to do. Once i set the wheels in motion ParcelForce's own ineptness was their downfall - while i cant be 100% if you do kick it off (and their system and lax employees are still functioning the same way) itll be a cake-walk...Pm me and ill explain all if you want to.
This is an important omission from your first post. You need to identify who your contract was actually with. Using the eBay postal service suggests your contract was actually with eBay/Packlink and it was they who contracted Parcel Force. Yes, hear ya. I am exploring both options but dealing with both these organisations is hugely frustrating, deliberately so I feel. They will no doubt try and blame each other but I am leaning towards EBAY as to me they are the agent I purchased the service from with my c/c, even if it was PFs ineptitude that caused the issue. My assumption is twofold on that they have both a fiduciary responsibility to me as a service user/purchaser and a legal, not to say moral, responsibility to ensure the services they provide and recommend are fit for purpose. But whatever plan I pursue I think it's going to be a long journey!
If it goes the way mine went....it didnt take long i think i was all done and dusted in about 6 weeks....the most i had to do was threaten Parcel force for the money at the end but by that time the law was on my side...
Parcel delivery if very competitive these days. A lot of firms employ "agency workers" . Hence the poor service.
The "agency workers" get virtually no rights, paid holidays, pension contributions etc etc. They also typically supply their own vehicles and fuel. Each delivery earns them *60-70 pence, but if they don't leave the parcel 'cause you are out, its considered a failed delivery & they get nothing. This is all in the direct control of the companies who have clearly pushed the staff beyond what is reasonable. *Evri pay 50p for small packages.
