Missing documentation?

  1. It is quite clear on the reg Doc what is supposed to be completed etc etc when selling privately or transferring to a dealer.......none of the parties in this issue have complied (not even El Toro, unfortunately...because he can't).....

    .....the original registered keeper is still liable for the vehicle, so I suggest El Toro tells the dealer he will go and activate a few speed cameras...the registered keeper will soon present the document if he thinks he is going to get a few speeding tickets.

    I was giving a "reputable dealer" with an allegedly "reputable" client the benefit of the doubt.

    Trust me if this goes tits I will have no hesitation in going legal.

  7. Sorry ET, but if you have "owned" the bike for five weeks (!) without getting it registered in your name, you have already been extremely remiss legally.

    The dealer and the previous owner may have messed you about something rotten, but the main responsibility is your own, I'm afraid. You may find yourself in front of a judge explaining what you thought you were doing - and he may not believe you.

    I suggest you give sorting this out a very high priority, even if you are busy on other matters, as there is scope for getting yourself into deep shit with this.

  9. There is also the question of whether you are properly insured if legal title is in doubt or you are not the registered keeper.

  10. Hmm, a proper franchised Ducati dealership you say? Perhaps you should inform Ducati UK/Italy of this debacle and see which way the wind blows.

    E-mails? I'd give em bloody e-mails, telephone calls etc, friendly pressure, catch my drift ...

I would suggest that you ring trading standards in the morning to see where you do actually stand, tbh with you though you were silly to have taken the bike without getting the green slip.....the dealer in question often sell bikes on behalf of people however that said it is their responsibility to ensure all paperwork is in place to hand over at sale....you do have an issue with insurance as you are claiming you are the registered keeper but effectively you are not and the registered keeper should be insured on the vehicle and as i am sure he wont be your insurance is invalid, i know this as we have had to do the same with the 748 after i passed as it was originally registered to butch, Legally you own the bike because you have a receipt for the transfer of sale however the registered keeper is liable for tax insurance etc of the vehicle. When I bought my RS the dealer taxed the vehicle and passed me the docs however some weeks down the line I realised I had not received the V5 it soon became apparent that the v5 had not been sent to dvla to register me as the new keeper, it actually cost me 25 quid to get the v5 but it made it mine! The fact that you have not received everything that you were promised at sale is effectively goods delivered which do not meet the standard that they were sold at therefore like I said a call to the Trading standards will be your best bet then ring ducati and tell them that you have been more than reasonable and have contacted trading standards they will deal with this immediately because they will then be on the T/S register which is not good business practice. You also do not want to accept their offer of the return of your old vehicle as this may not be in the same condition as when you traded it, I would also argue that they replace the ignition and fuel key cap to a new one if the spare key is not available, the old owner has no excuse not to gather the docs etc and therefore with his hesitation it would give me cause for concern??.....I would put this on your priority list and also as get that HPI check done....a learning curve mr El T!!!!! Next time i see you I shall give you a pixie spank!!
     
  12. Registered keeper doesn't need to be named on any insurance. They are simply the one liable for taxing, and knowing its state.

    Since you have a paper trail and receipts I wouldn't worry too much at this stage.

    Your contract is with the dealer. If its stolen, has finance, or wasn't available for sale you would get your cash back very easily.

    More likely the v5 is lost, so the dealer needs to pay £25 for it to be replaced or something else silly.

    However, from my dealing with the person / company in question (I think) please get it sorted sooner than later. Expect lies on top of lies. I've sent u a pm regarding it.

    Trust me, I've been in motor trade for over 10 years and have seen it all before.

  14. Tell the dealer you want your R1 and the cash back come the weekend and you'll be dropping your bike off etc, dealer would shit himself.

    Typical after sales service, I'd personally make them squirm as much as possible if they can resolve it quickly get the dealer to throw in the next service, parts accessories

  16. I think I'd just be telling them to prep the R1 for collection with your cash on Saturday if they can't provide you with the legal documentation before then, and call their bluff!

  20. It's the key I'd be more worried about.

    If it clears the HPI, then worst case you apply for a new log book for £25 quid.......now price a key!
