This is not a civil matter, but a criminal appeal, as far as I understand it. Under South African law, the prosecution can appeal to a higher court against an acquittal verdict. Bear in mind that there was no jury - the verdict and sentencing were done by a single judge. The main options were premeditated murder and culpable homicide. The trial court found Pistorius not guilty of premeditated murder, but guilty of culpable homicide. The sentence reflected this. The prosecution appealed the verdict of not guilty of premeditated murder. The Supreme Court heard this appeal and has recently decided to allow the appeal, which means that the not guilty verdict is quashed and a verdict of guilty of premeditated murder is substituted. The case was then remitted to the court below for re-sentencing in due course, which is now awaited.
@Pete1950 I thought that it was a civil action brought by the family of Reva which I think was being discussed as an option some time ago. I much prefer your explanation though.
There may well be a civil action for wrongful death brought by the Steenkamp family pending. But the recent news item was about the criminal appeal. In the famous American case of O J Simpson and the 1994 death of Nicole, there were three sets of proceedings: the criminal trial, the civil action for wrongful death, and the child custody case. OJ won two but lost one.
