Back After Accident

  2. It's all so bizarre. My eye appointment has been moved to Cheltenham because they have moved all the equipment from Gloucester as that hospital is the Covid Centre. I could get the train to Cheltenham (it's only one stop after Gloucester) but it just means a taxi from the train station to the hospital as it is a bit far for me to walk - about 25 minutes for someone who is fit. But under the rehab code, they are funding me a taxi all of the way from my house! Some things that I wouldn't dream of asking for, they fund without question. Yet my solicitor struggles just to get them to admit that I exist - despite having my medical notes and a police report blaming their client 100%.

    I don't know how my solicitor does it. It would drive me mad and I would just end up screaming at my staff! She did talk about going to court quite early on in the process. "That is taking it a bit far, so early in the process", I thought. But now I have learned that this is the only language that they understand.

    My first impression was that she seemed to spend an awful lot of time in court. I thought that strange because they only do personal injury stuff against insurance companies. But that is how is seems to be. The mentality seems to be that they would rather spend tens of thousand on fighting cases that anyone could tell them that they will lose. They must have solicitors who work for them who must know the score. And when they engage a barrister then they will have the benefit of a solicitor and a barrister telling them that they are wasting their time. But it seems that as an insurance company, you listen to nobody. The competition seems to be among insurance companies, who can piss the most money up a wall!
     
  3. I understand your viewpoint but sometimes I think life would be simpler if I could just forget all the insurance crap and get on with my life! But, that is easy for me to say. Knowing that I will get something one day - how much and when, nobody knows - does mean that I don't have to worry about things long-term.
     
  4. It’s also so unfair on you. By dragging out the liability issue they are causing you added stress, I can only think they’re trying to wear you down.
    One trick they tried on me was to put forward a Part 36 offer of £30K to try and scare me into accepting.
    This was before they had seen my medical records!!
    My Solicitor gave them a week to withdraw the offer or we would hand the case over to a Manx Solicitor and proceed under Manx law. Part 36 doesn’t exist under Manx law.
    You’ll have to look up Part 36 as it’ll take me a week to write an explanation.
    They didn’t back down so off to the Island we went.
    I feel for you as my case engulfed my life for 6 years and nearly broke me on a few occasions.
    I just can’t get my head around that the other side has been convicted and they won’t admit liability.
    You’ll get there, but as I keep saying: Patience.

  5. I will look up "Part 36" or bug my solicitor with a question. I like bugging solicitors when somebody else is paying! Although, if I can get a trip to the IOM out of it, then I'd be happy!
     
  6. Which Gritchie? I had a look at the website and they will deliver but there are a few beers to chose from. Or, are you going to make me go through entire selection to chose which one that I like? Tough call, but I will sacrifice and do it!

    this is the most expensive of all the beers as the bottles are those tiddly ones !!!

  8. The accident was on the Island which is why we had the choice of English or Manx law.
    You won’t have that choice I’m afraid, but when you finally get sorted treat yourself to a TT trip and I’ll meet you for a pint of Manx ale.
     
  9. Although I have always followed the TT (since Hailwood won on the Sports Motorcycles Ducati), I have never been. I did a contract for Eagle Star International Life (I think it was) and I was there in September when the Manx was going on about 20 years ago . It was quite surreal - walking back from the office to my hotel along the sea front and bikes returning from evening practice, especially sidecars, would be returning from (or going to) practice. Although totally illegal for the road, they obediently waited at red traffic lights. That was surreal!

    But it is my intention to do the TT, definitely!

  12. Perry, ‘Part 36’ is to do with the Civil Procedure Rules (CPR). In short, under that section if a party who is possibly liable makes an offer of a settlement to the injured party the injured party has 2 choices;

    1. accept and the matter is closed and the injured party receives the cash, or,

    2. reject and let the matter go to trial. HOWEVER, if the judge/court subsequently finds in favour of the injured party BUT awards less than the offer then the injured party has to pay the legal fees of the liable party. Reason being they could have accepted the offer, got more cash and saved the other side spending money defending it.

    It’s often used as a tactic to pay out less than they might otherwise be ordered to pay.

  13. This is where having the right Solicitor is key.
    It’s a nasty tactic that takes advantage of people who are vulnerable (in a lot of cases).

  15. Thanks for the explanation. Makes sense.

    I guess that if that was to happen to me, then it would be a difficult call. Of course, I would listen to my sol BUT she will want to ensure that she gets paid and I'm not paying! So, if she says, "don't take it and we will fight them in the courts" then that would be advice that I would take definitely. If she said, "Accept", then that would be a more difficult quandary. Is she saying,"accept", to make sure that she gets paid, or is it because that is what they really think? That would be a difficult call - especially as my quest now is to make the insurance company suffer as much as possible.

  17. I will be in the market for a Guzzi. Before the lockdown, a mate was going to take me to Motocorsa's showroom for a look - and to try out the coffee shop!

    The Guzzi thing is bit of a quandary. My nearest dealer is Fowlers in Bristol. They are very big and sell most of the big makes, as well as KTM, Triumph, and Guzzi. Motocorsa are smaller and more traditional with selling more interesting makes.

    Neither do Ducati. Bristol is sewn up with Riders (in Bristol and Bridgewater), but Wiltshire (especially mid) is not so well sorted. Who is Wiltshire's "goto" Ducati dealer?
     
  18. Your Solicitor has to act in your best interests or there could be repercussions. WCP or Zhed will be able to explain this better than I can.

  19. Motocorsa’s showroom & cafe are fabulous, service is great to - they wanted the Ducati dealership but Ducati refused as said too near Riders & Motorapido

    oh uses motorapido & sometime Snells
