Legal Issue With A Customers Twin Shock Trails Bike

  1. ok collected a ty250 trail bike 3 months ago from dk in staffs for a German fella who I have been to before, all arranged I popped in and collected it en route from Spain brought it back home and was looking for additional jobs before lockdown to take to Germany it was while searching I discovered the German fella had put the bike on these sites to get it delivered by someone else but I already had collected it so I have seen red put it in storage and told him to move the bike as I won’t, it’s 3 months and tomorrow 12pm uk time I have told him the bike gets sold to pay my fee and storage, I have warned him numerous times I will not move it but I just get abusive emails as does my mate who has it in storage

    He emailed me the other day been all nice offering more to take it but absolutely no chance I will take it i told him to organise alternative transport but despite getting offers online has not taken them so we have an issue it’s only 300€ for me and storage yet he won’t pay

    Have I given him reasonable amount of time? I think I have been more than fair

    As a side note there is possibly a cheap ty250 available tomorrow
     
  2. I wouldn’t think it’s yours to sell. Why not just deliver it and charge an idiot premium?

  3. How will the money be paid that is owed? I’m not going to take the bike he was dropping me like a hot potato I would have turned up to be told bikes gone...he is a shithouse

  4. I actually reduced my fee from 190 to 150 for no good reason but still no effort to arrange payment

No paperwork at all with the bike I just collected it and drove off, the cheeky bastard even said I only collected it to stop someone else collecting it wtf I collected it because we had an arrangement for me to collect it I only saw he had advertised the collection as I went to search for jobs to take over but when I saw what he had done that was it I refuse to take it, thing is people were bidding on this job while it’s been in storage yet he has not accepted the bids so who’s fault is it? I’m not going to get turned into a frankfurter
     
  6. Tell him he can send anyone he wants to pick it up but it wil not be released till the agreed fee you were promised is paid

  7. he has been told that a few times, just send someone pay what’s owed and take the bike....3 months this cannot go on
     
  8. I also dropped my charge and no reason on earth I should lower my charge and storage 150€ for 3 month I don’t think he has been robbed

  11. Assume he bought it from the dealer? Seems mad unless it’s going to cost as much as it was to buy so buyer cba now?!
     
  12. I’m actually thinking it might fetch a tad more but honestly don’t want this shit I’ve given him 3 month I’m sure plenty of people would have sold it and got on with life

  14. His last email said you want war you got war? Excuse me but I just want paying I am on the volunteer service but that is my free work in its entirety I pointed out I am self employed and do not work for nothing
    The bloke is a twat, at no point did I mention to look in the history books after his war invitation

  17. You have exercised what’s known as a lien on his goods to set off/pay the damages he owes you for breach of contract. You’re also exercising what’s known as a bailment by storing it, for which you can charge a reasonable commercial daily rate. There are statutory procedures for giving warning or notice of sale of goods which have been left behind, under the Torts (Interference With Goods) Act 1977 but they don’t have to be followed to the letter, but if yuh do it amounts to a defence to a claim for conversion ie: trespass to chattels (moveable property as opposed to land). However you should sell it for reasonable market value and pass on the balance or he could sue you for it.

    The complicating factor is the cross jurisdictional issue but happily, nobody will give a toss as its not worth going to all the hassle it will be to sue you for the price of the bike minus your fee and charges.



    Invoice in the post, which, coincidentally, is for €300, or the bike by way of barter. :upyeah:

Cheers zhed I still have the bike, I reduced my charge to encourage closure and storage was a paltry bit over 10€ a week as not greedy just wanted him to arrange collecting by another transporter and pay the 300€ I’m baffled this did not happen so I’m now stuck with a very nice twin shock trail bike and I’m unsure hat to do as I have heard nothing for a week and deadline went by last Saturday
