Bet You Are All Wondering

  1. Well, not really. I am having to do an investigation into places where I worked and for how much, for my sol in her fight with Hastings.

    There current bent is to deny that I was even riding the bike, with me, the Police and the hospital all lying. It's quite funny really.

    And interesting because with a good smack on the head I've forgotten so much. One place that was in the back on my mind was Chesterfield Royal Hospital! I know that I worked there as I can remember it now. It was shit as they even made staff pay to park in the huge, empty car park!

    I've also found a contract to work for British Nuclear Fuels at Windscale. I can find no evidence that I actually did any work for them and I don't glow in the dark!

    My motorbike odyssey is entertaining though. My Autotrader search for local bikes between 4 an 8k is coming up with lots of Triumphs, if I ignore all of the Jap crap. Not may Ducatis! I've never had a Triumph and they are starting to interest me.

    If I ever get my license back then I am looking at local cars for the same money. Tempted as I have to pass the driving assessment in a car, anyway, and not sure how strong my leg will get.
     
  2. Sounds like they are making a case for your loss of memory and finding any excuse
    Make sure you CAN find out where you worked to prove to them and DVLA that there is not a lot wrong with your memory ;)
     
  3. Take a gander at modern Trumps Pez. The build quality and materials finish make Ducati look like cheap junk. I'm not after a rocket, but I had a real good look at one and it just oozed build quality. Ive not been impressed with the quality of materials and finish on my 1299S. My 916 looked better built.
     
  4. Your tax records will show places/companies you worked. Not sure how easy it is to get this info tho'...
    How can anyone deny your accident - your were stretchered off FFS!

  5. To be honest, I'm past caring. I emailed my sol and told her that I am quite annoyed with the DVLA thing as I am treated as the person at fault. She said that it is no big thing compared to the overall amount we are going to claim! Interesting And funny as I know that before the pandemic, my sol was in court most weeks - and she only takes on cases that she is pretty sure to win.

    Her fees will be added to my claim and they must be quite tasty. She has about ten staff working for her and her practice recently took over another practice. What I don't understand is that Hastings MUST know of her and know that this is gonna cost them thousands - I would not be surprised if her fees are running at 20-30k at the moment. What I do not understand is why some senior management t don't question why they are p1ssing thousands away arguing that black is white. Insurance companies seem to be incredibly thick if they don't realise that they could save fault accident claims for thousands less, if they made offers to settle them quick, rather than go to court to be laughed at by the judge and hit with much, much more losses in judgements.

  6. That is what they do. Your claim is not special to them and is merely part of the game. I was promised over 750k from the preliminary investigation of my accident, where I was non fault. They dangled this for 3 years until a week before the cut off date for requiring court proceedings. It then dropped to 200k take it or leave it.

    Part of the initial agreements were that if I went against their recommendations and the case was lost, that I would be liable for all fees. The gamble for the bigger payout would have lost me my home if things had gone pear shaped. The 200k payout did not even cover my full loss of earnings for those 3 years, nevermind future losses.

    Don't make the mistake of thinking you are anything more than income for them.

  7. Well, perhaps the ambulance people are also lying too! Along with everyone else - even their own insured driver! In fact, she always admitted fault and that would have really p1ssed off Hastings!

    Because I always worked through my own company, HMRC will be of no help - are they ever? Their records will just show that I worked for my company for the last 25 years odd. I never worked at Windscale, I'm sure!!!

    And what is more important and I must remind my sol to add it to the claim - I never got my underpants back! Question is: did they have to cut them off or where they too stained and beyond cleaning? And my socks! I got my boots back but no socks!
     
  8. strange reasoning from Haslings.. makes you think there's going to be a "penny dropped" moment hidden away somewhere, even makes you wonder if they are close to folding or something.
     
  9. My sol is very careful not to put any figure on what the claim will be. I assume that this is not to get up my hopes and expectations. I intend just to accept her advice on what to accept. After all, this is what she does and I have zero experience. As long as I get a bike out of it at least! I wanna put myself in the position of do I buy a brand new Ducati or something second-hand for 4-8k. Actually coz you won't be able to buy petrol bikes after 2030 I might buy new to last me into the 30s. Aw feck it! I want a Triumph and a Ducati. I'll buy both!

    NO, NO, NO! I need to calm down and restrain myself!

  12. Not ruling out a Triumph or the Supersport s, but I've given up looking at second-hand. This will probably be the last bike that I buy and I've lost this obsession with wheel size. I haven't ridden a bike in over two years and it could have square wheels and I wouldn't notice, My top choice has gone back to where I was a few days ago. The KTM. And it works as the first bike that I ever had was a KTM, so I can make it the last one - although I might be a bit pessimistic as there is no rule saying that when I'm an old Ginter, I can't still buy bikes. I'll see what happens. Although I just read a test of the KTM against the Kawasaki Z900 (and Kawasaki is the only Jap make that I would ever consider) and the tester reckoned the Kawa was better! And my local dealer (Frasers, is a Kawasaki dealer) and I am going to stop thinking about it as it just makes my brain hurt.

  14. Hastings were my Insurance company - they paid out quickly on my bike - as it was Full Comprehensive -

    But the Excess and NCD and Personal Injury took 6 months - and only settled after I proved to them that it was not a 50 50 liability split that they wanted to do.... as did their Legal Cover Team (that supposed to work for you not the insurance company)

    I assume so them and the other company would not pay out the Excess - and me and the other driver would have both lost out - no claims and me injury claim right.

    To do this - I had to sent them pictures of my motorbike - under the car that rear ended me and a photo of the page from the manual that shows my motorbike did not have reverse gear....

    So clearly I was not at fault - and the other driver rear ended me... (No one other than the insurance company were claiming otherwise)


    Had a similar thing with my daughter - they wanted to settle 50 : 50 after a driver overtook her at a roundabout entrance (in the turn right lane) then turned left directly infront of her and clipped the front side of her car and did not stop for 200 or 300M after my daughter gave chase..

    I had to send photos of the road markings and signs to show that being in the right lane mean he should have turned right not left.... clearly the insurance companies want to go for no fault claims to limit their mutual liabilities...

  15. I've had thre 675s down the years, absolute hoot to ride and the sound on the over run is extremely addictive. Well worth anyone's 5-6k I'd have thought.
     
  16. My mind is made up! I can cite brain damage if I change it again! When/if I get some money and my driving license back, it will be one of the KTM Duke R, Ducati Supersport S, or some sort of Triumph. I will need to visit the Triumph place in Cheltenham, AMS in Tewkesbury who are KTM specialist, and Riders in Bristol, for the Ducati. I am likely to be swayed by viewings and test rides, but at the moment, the order is KTM, Ducati, and Triumph.

    Wheelie popping is not a consideration as I cannot risk any form of leg injury. Touring potential/ability is not either. I've toured on my, now deceased, S4r Monster and that is probably about as unsuitable a tourer as you can get. Also, I should have my ST3 for touring. I will probably part-exchange my ST2 just to create space, although when I get the valve check finished it is a good bike! I will offer it here first - not to try and get more money but to see if go to a good home.
     
  17. Are you sure the brain damage was due to the accident and not just a characteristic?

    Those 890's get very good reviews.

  18. Possibly! I had a horse riding accident in 2009 (I think) and spent some time in the Brain Injury Rehab Unit at the old Frenchay Hospital site in Bristol. That was the place that treated Richard Hammond but he couldn't stay there, as they didn't want press taking photos through the windows, so he paid to stay at the posher Glen private hospital in Clifton. This time, I didn't go to the BIRU in Gloucester but used to see consultants from there. They discharged me as I was beyond help!!!

  19. And I got bored looking at used stuff in Autotrader and the like. I will buy new, or used if the dealers that I visit have anything good.
     
  20. And Aprilia! I really need to see one in the flesh. The RS660 is the other possible. So, KTM Duke R, Ducati Supersport S, Aprilia RS660, or some sort of Triumph.
