How do you not find someone guilty of attempted murder when they stab someone in the head with a large knife; and how can you not unanimously find him guilty of wounding with intent? Perhaps it is time for a change from the jury system...
It sounds like a perfectly reasonable verdict. Here’s how. Attempted murder is probably the most difficult charge to prosecute because it requires the Crown to prove that the defendant specifically intended to kill the victim. Murder is actually much easier to prove as it doesn’t require specific intent to kill - merely a specific intent to cause GBH. It’s basically s.18 GBH but the victim died. The victim in this case didn’t die and the boy was (probably correctly) convicted of s.18 GBH. As for why one or two jurors didn’t think he was guilty of s.18, only the lesser charge of s.20, the answer probably lies in the evidence presented at trial, which nobody apart from them and the other participants in the trial, have seen and heard.
