So perhaps some of you may have seen my thread and tale of woe re the theft of my beloved Delilah....(multistrada) a few weeks ago.... 1200 - Stolen Multistrada Alert | Ducati Forum Well the plot thickens.... Axa the insurers are refusing to pay out!!! The reason being....the bike is to be "kept" in the garage when at my home address! (the bike was stolen off the street whilst i was having my dinner before heading off again ie temporarily parked at 20h30.... Now I was aware that it was a garaged policy, but the statement of fact issued by Motorcycle direct clearly states " will the bike be garaged overnight? to which the answer is YES"!! (I did store it in the garage every night) Surely it cannot be expected that simply because you have a gargaged policy you cannot park your bike on the pavement "ever"??? Anyway the real question is....do I find myself a good solicitor (anyone out there that can recommend an expert when it comes to insurance companies and nailing their balls to the wall....) at this moment, or should I follow the complaints process "al la" Axa insurance and complain to their customer relations department first.... Must say I am starting to lose faith in humanity....first the bloody thieving bastards that stole my beloved bike (may they have a slow and painful death then rot in hell) and now the insurance thieves....

Have they got you with the 'if its within a certain distance of your house it has to be garaged' clause?
Is it 'reasonable' to expect someone to park in the garage every time they return home, regardless of time? Even at 0400, if you were out and popped in, grab a coffee and head off, even with overnight policy is that reasonable? Equally, a big chain when leaving it down the shops? Most pay up because its considered and unreasonable enforcement of terms or an unreasonable term
I do not keep my bikes at home because of the low life scum out there that would be plotting to get their grubby mits on my hard won machines, they are in secure 24hour storage. When I added the 848 to the stable I informed them(insurers) that this bike too will be at the same address as the 1098 and the guy on the other end of the phone made it VERY CLEAR to me that when I ride home to be very careful. In other words, don't take your eye off the bike because if it goes we will not pay. Truth is, I never take my eye off them when I am out anyway. I had a 350lc stolen from Matlock many years ago so I know what you are going through so having this issue to deal with as well is a double slap around the face. I do hope you triumph over the insurance, they are not being fair
