No chance of the appeal being heard before the Valencia race. What is in issue is whether the penalty should be suspended in the interim, or left to stand pending appeal, and apparently the tribunal is to be asked to rule (on that preliminary issue only) before the race. When courts or tribunals have to give rulings about preliminary issues, the argument is always about avoiding pre-empting the outcome. This reminds me of arguments about reporting restrictions on trials; once reports have been actually published it is too late to issue an order imposing reporting restrictions. The cat is out of the bag and can't be put back in. So courts usually impose interim restrictions first and then decide whether to lift them or continue them afterwards. This preserves the position in the meantime. No doubt Rossi will engage the best lawyers to represent him (who incidentally will charge a great deal more than £790 per day). And they will be presenting his case pretty persuasively. I cannot see how the tribunal could really refuse to suspend the penalty and thus preserve the position until there is a substantive determination.
My earlier posts about Rossi not being the person people think he is, rings even more true to me now. I've got visions of him posing with his 10 championship trophies in a few weeks. If it happens, It'll always have a little ring of this picture about it.

Then surely you're left with a bit of a conundrum (more obviousness, sorry) as MM took a knowing dive into him to try and initiate the turn. Should the 'incident' start when Rossi runs him wide and end at the point that MM turns in thus starting 'incident' no. 2 in which MM comes a cropper? Imagine 2 guys in the pub, One pushes... Two pushes back, One pushes harder... Second one loses his footing and comes a cropper.... One gets done for GBH even though they were both just pushing..... How will it end? I don't blame him for making the appeal, it's not unsporting to do so and ultimately I personally feel he's got grounds as there was no previous case to go on in terms of the issuing of 3 points (or so I believe) for what he did. At the time when all the world was going mental thinking Rossi had kicked out due to the camera angles being shown then people were saying it was lenient, however after the dust settled and replays showed the actions more clearly it actually looks more like he simply pulled over with the intention of simply slowing down the situation and to highlight Marquez's aggressive riding up until that point. In fact Rossi had already turned away towards the corner by the time Marquez tips in, thus it was he who initiated contact. Technically it's hard to even say rossi ran him wide as rossi was ahead in that corner and as Brookes points out, Marquez could easily have chosen to pull underneath, not back alongside the outside

i think he would gain some lost respect if he just (rightly or wrongly) took his lumps, started from the back and did his best to win. goin down the road he is MAY get a championship but it WILL lose him alot of fans. the hard core will support him but those that have more than one favorite and those new to the sport wont. dont get me wrong i still think MM played more than a small part in this mess and they should both ave been punished or neither but what is done is done. get on with it!
