Bar - Stewards, Speeding.

  1. Just got an NIP in the post stating I was speeding on the A65, clocked at 107mph, the limit is 60mph !!!
    We saw the van ahead and slammed on, didn't realise they must have a camera on the front aswell to get my Reg...
    Problem is I've already got 6 points :scream::scream:,

    Do you reckon I'll be banned ??? If so for how long?? Anyone else been in similar predicament ??

  3. i would get legal advice before you return the NIP.. are the other 6 points for speed offences?
     
  4. Yes, the likelyhood is that you will be banned which would be just for exceeding 100mph regardless of the number of points already on your licence. Drivers do not always get banned and I believe this is where the hardship defense kicks in. If you are the only bread winner in the family and you would lose your job if banned might result in only a financial penalty. I suggest you get yorself legal advice. Andy

  5. Hmmm, yeah it's not going to end well I'm afraid. You could ask for speed gun calibration certs maybe. But they cottoned on to that loophole some time back.

    Give Nick Freeman a call! Seriously though if you're nicked at 107mph you'll be banned. 28 days minimum. You won't be offered a speed awareness course as your speed is too high. Take advice. Good luck mate.

  7. What is the likely length of an instant ban for a speeding offence?
    In most cases it can vary from 7 to 56 days, but the Court does have complete discretion so in an extreme situation a ban of 120 days or more could be imposed. However, if you already have 6 or more points on your licence and the speed alleged is so high that you would normally face an instant ban, the probability is that the Court will endorse your licence with 6 points, which would take you to 12+ points and trigger a 6 month totting up ban.

    I have been caught speeding at more than 100 mph on the motorway. Is a ban automatic?
    Although the Police attempt to resolve most offences by way of a Fixed Penalty Notice, at excessive speeds, a Court appearance is inevitable. For speeds in excess of 100 mph (or more than 30 miles above the relevant limit) the punishment starts at disqualification as opposed to penalty points. However, the decision is at the discretion of the Court and in certain circumstances, a disqualification can be avoided.

  8. North Yorkshire police eh ? You would get done less if you stole the bike and rode it through the police station with i hate the police tattoos on your bare arse. Speeding is worse than murder according to n.y. police.

  12. If you can demonstrate genuine hardship in the case of a ban, you may get away with 6pts instead, which would be a totting up ban but you would again escape a ban.

    I would suggest representing yourself, do a great bunny-in-the-headlights impression and try to look like you are about to throw up in front of the mags.

    Ask me how I know this.

    Begs the question how is doing "x" over the limit on a 250 kilo bike treated the same as in a 1.7 tonne car!

  14. Not been in your predicament but have taken it the arse a couple of times with SP30s. Pretty sure that last time they thought fuck the 30 mph limit in the village (where nobody breaks the limit due to parked cars on both sides), fuck the 40mph limit by the school and let us get traffic at 7.30am that is leaving the village just before the de-restricted sign.

    As I tentatively understand it, they will only give you the evidence if you plead not-guilty and don't bend over like a good little boy.

    That is why I agree with the advice regarding finding a good solicitor. My mate did try many of he free ones that he has with various insurance policies - and got nowhere as in he ending up giving the agent (not even sure if they were actual solicitors) legal advice that is not really the idea.

    If it was me then I would look for those who specialise in this type of thing. The Police bask in the glory that most people (like me) plead guilty by post thus they can claim to keep our streets safe whist not even leaving the canteen - or co-operating in making juvenile tv programs to show what good drivers they are in fast cars with excellent physical fitness....

    I believe that they are some who advertise in the mags but do find a good one. I would think that the priority is not getting banned - or if unavoidable, for as short a time as possible,

  15. technically the NIP said someone was speeding at 107 mph in a 60 limit, on the A65 at a given time date, some form of recording device grabbed an image after the said speeding offence of a motorcycle believed to be bearing a registration number that when checked against a data base is registered to you.

    The NIP is asking you as a registered keeper to identify who was riding your bike at that time date, assuming it was you and or your motorbike! o_O

  17. When i got caught doing a little over double the limit I got a layer and ended up with a 3 week ban. Was over Christmas so worked out ok :upyeah:.

  19. And if you falsely write that somebody else was riding your bike at the time, the charge increases to attempting to pervert the course of justice. Which is usually a prison sentence.
