The thing is these days is that to make it road legal it's a lot more than just an exhaust change. They mention there's no ABS for instance which is something that has to be on new road bikes now and adds a bunch of weight, size and complication. The design brief is the ultimate race bike and you simply can't achieve that now if you want to make it road legal since the requirements have diverged so far.
Sounds like a step forward for BMW: build a bike for racing, then make it a road bike. Something Ducati did until 1098 era very well.
