  1. yep I was, its a long hard 3hr slog sometimes ;)
     
  2. The English word "manslaughter" does not translate very well into some other languages. It sometimes comes across as an offence which is impliedly more heinous than murder, instead of less. Hence the desirability of using some other expression in the first place. "Culpable homicide" sounds pretty clear to me.

  4. Fair enough. But then what would be non-culpable homicide?
     
  5. You might kill someone in self-defence. You might be a soldier in a war obeying lawful orders. You might be an executioner implementing the death penalty. Etc etc.

    To be honest I thought he'd get away without jail. Too much media attention I guess.

    Over there, if he behaves, 5 years = 10 months.
     
  13. Yeah, the thing is, what is the custodial sentence meant to achieve?
    • Society's retribution.
    • To show that you can't just go around shooting people dead
    • Some species of recognition of the family's loss.
    • To make a point to Pistorius.
    What it isn't going to achieve is making any real difference to Pistorius' behaviour now. His life is ruined, and he has been through a hideous ordeal: even if you had an argument with your girlfriend, you don't actually want the reality of shooting her with dum-dums. He's highly unlikely to shoot anyone else, even if he wasn't jailed.

    So this seems like a good sentence. The damage has been done. Having Pistorius mouldering in jail for years and years won't bring Reeva Steenkamp back or achieve anything further.

    The fella shot someone dead through a door, under highly suspect circumstances.

    10 months and then house arrest for the balance is a joke.
